Fair use rationale in Ludwig Wittgenstein

[edit]

Though this image is subject to copyright, its use is covered by the U.S. fair use laws, and the stricter requirements of Wikipedia's non-free content policies, because:

  1. It is an historically significant image.
  2. We have no reason to believe the copyright holder would mind.
  3. There is no possibility at the moment of obtaining a release or a free equivalent of the school at this age.
  4. It is low resolution.
  5. It has no monetary value that would be affected by our use of it.
  6. It is only being used for informational purposes in an article about the subject.
  7. It enhances the readers' understanding to see that Wittgenstein, from one of the wealthiest families in Europe, attended a very ordinary looking school in a working-class area.
  8. His schooldays, and the fact that he attended school with Hitler, is the subject of much debate.
  9. The image is probably in the public domain, but because we don't know the first publication date or the author's dates, we can't claim that at the moment.
