Family portrait of Frederick Trump

[edit]

Various versions of the same image. Author "unknown", date "circa 1915" isn't enough to ascertain the copyright status of this presumably U.S. work, I think (date of creation isn't necessarily date of first publication). COM:PRP?

As far as I know, a formal transfer of copyright from a photo studio to the customer isn't something that really happened often, at least here in Europe. Quite the contrary, photo studios kept the negatives as well as the rights and offered to sell more copies if needed. Was it different in the US in Frederick Trump's time? PS: Also, public domain in the U.S. for works of this time doesn't depend on the date of death of the copyright owner, but on the date of first publication. The template {{PD-old-100}} which you suggested, BevinKacon, contains a note You must also include a United States public domain tag to indicate why this work is in the public domain in the United States. That could be {{PD-US-expired}} if the photograph was first published before January 1, 1924. Gestumblindi (talk) 18:26, 22 June 2019 (UTC)[reply]
Keep. Has anyone claiming to be copyright holder complained about this?Batvette (talk) 16:56, 11 July 2019 (UTC)[reply]
Per COM:PRP, arguments like "the copyright holder has not complained / will not complain" are not valid. Gestumblindi (talk) 18:57, 11 July 2019 (UTC)[reply]

Deleted: per nomination. Family photos are often not "published" close to the date they are created, so we'd need to establish a publishing date. --Sebari – aka Srittau (talk) 12:21, 14 November 2019 (UTC)[reply]
