Jamie Shupe (born 1963) is a retired United States Army soldier who, in 2016, became the first person in the United States to have their sex legally declared as non-binary. The Portland, Oregon court ruling in the Multnomah County Courthouse by Judge Amy Holmes Hehn is described as the first of its kind in the U.S. by the Transgender Law Center and Lambda Legal. After requests for legal assistance to the American Civil Liberties Union and LGBT advocacy group Lambda Legal led nowhere, Shupe began interviewing Oregon lawyers, ultimately hiring Portland attorney Lake James Perriguey. For their honorable service, in order of precedence, they were awarded two Meritorious Service Medals, four Army Commendation Medals and eight Army Achievement Medals. The Daily Dot published Shupe's DD214 discharge record and early life photographs in 2016.
Shupe describes the period of their military service as "living in fear" of being discharged and states the harassment they suffered for being viewed as gay while on active duty significantly contributed to them developing PTSD.
The U.S. Government's Department of Veterans Affairs website describes Jamie Shupe as a notable veteran.
Non-binary gender court case
Initially assigned male-at-birth, Shupe previously changed their sex to female in 2013 while identifying as a transgender woman

Early Life
Born in Washington, D.C., Jamie Shupe prefers the pronoun, “they,” but would rather be called Jamie in place of a pronoun whenever possible. Shupe grew up in southern Maryland, a rural and conservative area as one of eight children. They chose the name “Jamie” because it was a gender-neutral name and the New York Times reported Shupe's name change done by the Transgender Legal Defense & Education Fund (TLDEF) is court sealed.
Married to a woman, Sandy, for over 29 years, the two have a daughter.
During their childhood, Jamie got admonished for acting like a "sissy" and denied the right to explore their gender expression or gender identity. That suppression continued through their military career which included periods before and during Don't ask, don't tell.
Military Career
In a military career spanning from 1982 to 2000 and lasting 18 years, Jamie Shupe served in the United States Army as a tank mechanic, before retiring as a Sergeant First Class (E-7) from the 10th Mountain Division in Fort Drum, New York.

Before Oregon became the first U.S. state to allow residents to identify as "non-binary" (neither male nor female) on their driver licenses and identification cards as a result of Shupe's court ruling, the state hosted two public hearings. During the hearings, the only substantial opposition to adding an "X" marker to Oregon identification documents was the cost to update the licenses, forms, and policies in the state's administrative departments. The estimated expenditure for the Oregon DMV was only $39,000 and less than a half million dollars for all Oregon State agencies combined.

Shupe is an outspoken critic of transgender surgeries, citing the high complication rates and was hospitalized twice in late 2017 after a series of estrogen injections as part of their hormone replacement therapy destabilized their mental health.
