While the file has been uploaded at Flickr under a CC-BY-2A licence, it is unlikely that the uploader owns the copyright to the drawing depicted. The uploader's account has a large number of old advertisements and brochures in it, and it is more likely that he is simply placing copies of ads he likes in the account than that he has actually created all those ads and brochures and holds copyrights to them. The COM:EVID policy is very clear on who has to demonstrate what and it is the uploader or someone wishing to retain the image who have the burden of proof. This only your opinion, this is not a fact. I added to the picture a link to the picture page in The National Photo Collection of Israel. You can see the publication date there. I quote here what User:Prokurator11 wrote in Commons:Deletion requests/File:Aharon Hoter Yishai.JPG : Despite the neutrally phrased disguise, the nomination is clearly based on URAA-related arguments, which, as the community has quite clearly stated, may not be used as the sole reason for deletion. The only relevance of proof of publication before March 1, 1989 (the date the US joined the Berne convention), would be for the purpose of establishing the applicability of COM:Subsisting copyright in the context of URAA copyright restoration. However, it is not sufficient to establish that the work is not in public domain in the US under URAA (and it is evidently not). While this image is without question {{PD-Israel}} there is no indication that it is free in the US or any other country that does not use rule of shorter term.Following Wikimedia Foundation issued the following statement on 14 February 2012 where they recommended "Commons community should still examine media on a case-by-case basis" and the long standing requirement of COM:L that images must be free to use in both United States and in the source country this image fails on the first of those and should be deleted. It lacks any firm proof of publication in either Israel or the US prior to March 1, 1989 and should therefore should be deleted as failing COM:L as not being free in the United States. The only relevance of proof of publication before March 1, 1989 (the date the US joined the Berne convention), would be for the purpose of establishing the applicability of COM:Subsisting copyright in the context of URAA copyright restoration. However, it is not sufficient to establish that the work is not in public domain in the US under URAA (and it is evidently not). The relevant question would be whether the work is in public domain under the applicable law other than URAA. The reason for this DR is there is nothing to indicate that this image is not still in copyright and its copyright in US and did not need the URAA to have a copyright restored that it never lost and it's copyright in the US is as a result of the en:Berne Convention Implementation Act of 1988. The only way that it is not copyright in the US is if it was published in the US before 1989 and that publication did not have the correct copyright notice. Now given there is nothing to suggest publication in Israel or anywhere else before that date, let alone the US, I don't think there can be much no doubt that this image is in copyright in the US.   •  Delete File:VB UK Patent 883870.jpg per [3]. The patents are copyrighted. Pre-August 1989 patents belong to Crown (but can hardly be claimed to have the copyright term for Crown works as the applicants presumably weren't Crown employees. Post-July 1989 patents belong to the applicant. The Crown claims that you can use the material as long as you don't "abuse" it, meaning that there are restrictions and that the material isn't free. Later patents would be subject to the licensing policy of the applicant and has to be assumed to be non-free unless we know more about it.
  • Is File:EPLAX - Vero Catalogue.jpg from Germany or from the United Kingdom? Seems to be below the German threshold of originality but above the British one.
  •  Question File:VERO ELECTRONICS - letterhead.jpg: the typographic copyright has expired as it was published more than 25 years ago, but the British TOO is so low that it is unclear if there might be other problems with it. There was recently a case where some newspaper headlines were found to be copyrighted literary works.

This flickr image is indeed licensed freely but it has only 10 images on the flickr account. This flickr image is of low resolution too and is on probability, a flickrwash, I believe. This flickr account was created in December 2007 and the other 9 images don't show any personalities either except a derivative picture of Taylor Swift. Yeah, I have to try to find the original. But I would recommend looking at his gallery of uploads - he supposedly took this picture in the US while he shot the Granada in Northern Germany, and neither has any exif info.  Comment I'm pretty certain (90%+) this is a hybrid between Milvus milvus and Milvus migrans - note the intermediate length tail, and the brown (not strongly rufous) plumage, particularly the tail colour (a Milvus migrans character), but also a pale head (a Milvus milvus character). It is strongly intermediate between the two, but does not fit well for either, suggesting hybrid origin between them. But I don't have definite proof of its being a hybrid, which is why I put it in Category:Unidentified Milvus. Maybe the owners (Pairi Diaza zoo in Belgium) might have documentation of its origin. If it is proven to be a hybrid, then it could be of use on pages about hybrids, so I would not (at least for the moment) delete the file. It could also be of use on pages about zoos, too, to illustrate the frequency of hybrid taxa in zoos (this hybrid is frequent in captivity, e.g. London Zoo famously had 3 which escaped in March 2008, causing many identification problems for birders as they roamed around southeast England over the subsequent months). I would definitely say that this photo (and the other two of the same bird File:Unidentified Milvus (portrait).jpg and File:Unidentified Milvus (sideview).jpg) should not be used as an example of Milvus milvus, as at the links on the file talk pages, as it is misleading in that context. The owner of this home contends it is not possible to take this photo without taking it from private property, and no permission was granted. It appears the photo was taken from or near Gilbert Lane, which according to the article en:Fair Lawn (Cold Spring, New York) is private property. I plead completely guilty to taking the photo that way. I could argue that this is not a valid reason to delete the image, as under U.S. law the location of the photographer is irrelevant to any FoP claim (which wouldn't apply to a building this old anyway), and I can't find anything specific in our deletion or privacy policies about pictures taken on private property of private property not visible from a public place without permission (i.e., while trespassing), but in the interest of being nice and diplomatic I won't kick up a fussy objection over this. It's the right thing to do, and the replacement image will need some cropping but it does show the side of the house I'd like to show.

It is my opinion that we are not obligated to remove the image, however, I think it would be a nice gesture to do so. While I cannot reveal the details of the email, I was under the impression we would receive a nice photo in exchange, and while the one provided is decent, it is less of a close up that the prior one. Resolve all subcategories in Category:Movie posters of Japan from Category:1947 Japanese movie posters‎ to Category:1963 Japanese movie posters‎. Thanks. Wikimedia Foundation should find some legal solution to keep them for practical use in Wikipedias (Wikilivres.ca is not much practical, but at least it can keep them). I suggest to move (part of the) Wikimedia Commons out of the USA, because all of those images are copyright free in the world except the USA. I had to write it just for the record. Keep - Maybe I'm missing something here but COM:EDUSE says 'The expression "educational" is to be understood according to its broad meaning of "providing knowledge; instructional or informative".' This pic seems to fit squarely within that. "Unidentifiable people" doesn't seem to have anything to do with the scope, in any case "Educators" seems to be identifiable enough. There is absolutely no copyright problem with this photo, taken in Israel 53 years ago by the Israel Government Press Office. It is in the public domain here, there, and everywhere. This picture was taken in 1960 and it is part of The National Photo Collection of Israel see here and was published than when the actor Aharon Meskin was received Israel Prize by the prime minister of Israel David Ben Gurion. The COM:EVID policy is very clear on who has to demonstrate what and it is the uploader or someone wishing to retain the image who have the burden of proof. This only your opinion, this is not a fact. I added to the picture a link to the picture page in The National Photo Collection of Israel. You can see the publication date there. Publishing has quite a specific meaning in US copyright law, and the vast majority of photographs ever taken would not have been deemed published as they are not distributed to the public. While this image is without question {{PD-Israel}} there is no indication that it is free in the US or any other country that does not use rule of shorter term.Following Wikimedia Foundation issued the following statement on 14 February 2012 where they recommended "Commons community should still examine media on a case-by-case basis" and the long standing requirement of COM:L that images must be free to use in both United States and in the source country this image fails on the first of those and should be deleted. It lacks any firm proof of publication in either Israel or the US prior to March 1, 1989 and should therefore should be deleted as failing COM:L as not being free in the United States. Additional comment as I have been challenged by the nominee for this closure, and the comment applies to three similar deletion requests. What was not added to this deletion request was a link from an associated discussion taken to Commons:Administrators' noticeboard/User problems, which would have been helpful rather than to sit in isolation. Either way, it is problematic for the same user to continue to list and fight for a work to be deleted. That is not the purpose of having an opinion in these discussions. The principle behind reopening a discussion should ideally be undertaken by a non-involved person, or by the same person where new information comes to hand (as expressed in the surrounding box). There is no life or death here, the obvious get deleted or kept easily, the remainder are decided on weighing opinion. No one dies, there is no $1M riding on this decision, it is simply closed until we have better alternative opinion.
With regard to the points. While the evidence requirement is imposed upon the contributor of an image, it is to a policy written by community, and if the community sees that there is suitable evidence or knowledge about a work this can override the absolute requirement for evidence. It is the community's policy and it has the right to exclude components from 100% compliance, so the commentary by the Israeli community that the works have been published and that they are well known works should be heeded by the nominator and closing administrator. Further, there is a lot of tossing around of "precautionary principle" at times, and it was used in this case. If you the examples there are read, it is clear that they do not apply, and the description put in place by the community is "significant doubt about the freedom of a particular file it should be deleted and apart from the nominee, there was no significance in the doubt, in fact it was significance in its opinion to keep. If an admin believes that precautionary principle applies, then that should be clearly expressed in a closure, and it is my believe that where they are going contrary to the opinion it should be prior to a closure to give procedural fairness.
So with these four files, it is "PD-Israel" and accepting the evidence of the community's opinion, they were published at a point of time that makes them public domain in the US, so "PD-US".  — billinghurst sDrewth 07:34, 19 June 2014 (UTC)[reply]

Myslím ale, že tato fotka může najít uplatnění pro účely ilustrace ne kostela, ale vztahu pevného a pohyblivého bodu ve fotografii, případně pro ilustraci, jakého efektu lze dosáhnout obdobně nějakým filtrem v editačních programech. These are created by a user (using two accounts, Adrenaline Man and Andre Alexsen) who has never shown any interest in doing anything other than using the Wikimedia foundation servers to host a self-promotional page about himself and images of himself. None of the images is used on any page in any project, and as far as I can make out none of them ever has been: certainly none of them has ever been linked to any page by either of these two accounts. The user page is pure self-promotion, and copies of it under several different titles have been deleted from English Wikipedia, some of them repeatedly. (The user has been indefinitely blocked from editing English Wikipedia.) The categories range from completely emnpty (e.g. Category:Adrenaline junkie) to containing just one file, that being one of this user's pictures of himself (e.g Category:Daredevil (Andre Alexsen)), with just two exceptions. Those exceptions are Category:MMA and Category:UFC. In both of these there are several images in the categories, but the category pages contain only self-promotional content relating to Andre Alexsen/Adrenaline Man. comment I agree that these seem to be self-promotion, and if they are in fact deemed to be copyrighted they must obviously be deleted. That being said a couple of these images happen to include notable people for whom few or no usable images exist, specifially Benny Urquidez, and Gokor Chivichyan. Just something to consider.
